New York Attorney General Letitia James, who has built a national profile taking on former President Donald Trump with the mantra that “no one is above the law,” is now under investigation herself.

According to a report from Fox News, the U.S. Department of Justice—under the leadership of Attorney General Pam Bondi—has launched a criminal probe into James. A federal grand jury in the Eastern District of Virginia has begun issuing subpoenas related to allegations that James committed mortgage fraud.

At the heart of the investigation is a claim that James falsely stated a single-family home in Norfolk, Virginia, was her primary residence in order to secure more favorable mortgage terms. Prosecutors are reportedly also looking into a separate incident in which she allegedly misrepresented the number of livable units in a Brooklyn apartment building to qualify for better loan conditions.

These allegations stem from a criminal referral by William Pulte, the Director of the Federal Housing Finance Agency, who was appointed under the Trump administration. Pulte accused James of “falsifying records” on multiple mortgage applications—most recently in 2023—despite her legal obligation to maintain a primary residence in New York as a state official.

In a statement defending James, her attorney Abbe Lowell blasted the investigation as politically motivated, calling the allegations “baseless and long-discredited.”

“It’s no coincidence these claims are suddenly back in the spotlight just days after President Trump launched public attacks against Attorney General James,” Lowell said. “This appears to be the political retribution Trump openly threatened, despite AG Bondi’s assurance that she would not allow such abuse under her watch.”

Pulte’s referral letter to the DOJ claims that James listed the Virginia property as her primary residence while serving as New York’s top prosecutor. He also provided documentation suggesting she misrepresented a five-family Brooklyn property as a four-unit building in both permit filings and mortgage paperwork.

In another document from the 1980s and early 2000s, Pulte cited mortgage records showing James and her father claimed to be “husband and wife” to qualify for a loan—raising further questions about the accuracy of her disclosures, though those documents date back decades.

While critics see the DOJ’s probe as politically charged, James’ office insists she remains committed to her duties.

“Attorney General James is focused on protecting New Yorkers every single day—even as this administration weaponizes federal power against the Constitution and the rule of law,” a spokesperson said. “She will not be intimidated by bullies—no matter who they are.”

In his own letter to Attorney General Bondi, Lowell pointed to what he called the “stunning hypocrisy” of the Trump team’s actions.

“President Trump has long claimed that the Justice Department was ‘politicized’ and ‘weaponized’ against him—yet here he is, using it against his own critics,” Lowell wrote.

As the investigation unfolds, the case underscores the increasingly high-stakes legal and political battles between former President Trump and his longtime legal adversaries.
